Definitions of Terms & Conditions

  

'The Hirer’, ‘him' and 'his' refer jointly and severally to the person or persons who are the customers. ‘This Agreement’ means the Rental Agreement, the Insurance Motor Rental Agreement and these Terms & Conditions. In the event of any discrepancy between these Terms & Conditions and any other Budget Motorhome Rental literature, the provisions of these Terms & Conditions apply.
 

 - ‘Budget Motorhome Rental’ means BUDGET Milton Location de Voitures SAS

 

 - ‘Customer’ means the person or persons nominated as the hirer under the heading 'Hire Details' on the Insurance Motor Rental Agreement and any person whose credit card is presented in payment of the customer's charges.

 

 - ‘Rental period’ means the hire period referred to under the heading 'Booking Details' on the Rental Agreement or any agreed variation thereof and any additional period during which the Vehicle is in the customer's possession or control.

 

 - ‘Living equipment’ includes but is not limited to DVD player, CD player, crockery, cutlery, cooking utensils.

 

 - ‘Vehicle’ means the Vehicle described under the heading 'Vehicle Details' on the Rental Agreement and includes tyres, tools, accessories, the living equipment and any other special equipment, documents related to the Vehicle and any replacement or substitute vehicle which may be provided at the discretion of Budget Motorhome Rental.

 

 

 CDW

  

CDW at €15 per day will reduce the excess for any damage caused in a collision to either the Vehicle or third party property to €500.The Hirer will however be fully liable for replacement or repair to windscreen or tyre damage. Applies in respect of each claim, not Rental. Please note that the CDW Insurance is completely optional and can be decided upon collection of your vehicle. Please note overhead damage is not covered under CDW because of the (unusual) height of the Motorhome. Extra care must be taken not to drive under an obstruction that is too low for it to clear i.e. low bridges. In this event Collision Damage Waiver Insurance will not apply and the Hirer will be responsible for the insurance excess of €3000.

 

  Vehicle

  

 All Vehicles may only be driven on sealed and/or bitumen roads.

 
            - Delivery and Return of the Vehicle
 
The Vehicle must be returned on the date, and before the time stated, on the rental agreement. Vehicles must be returned clean and in the same condition as they leave the depot, otherwise a charge will be made.
 
If you will be late returning, the rental company must be advised immediately. Failure to advise may result in prosecution for driving whilst uninsured. An additional charge of €50 per hour will be payable for all late returns.
 
The Hirer acknowledges having received the Vehicle in a clean condition and in sound working order (the Hirer must not disconnect or/and tamper with speedometer. If signs of speedometer having been disconnected or/and tampered with are noticed , the Hirer agrees that he will pay Budget Motorhome Rental for the aforementioned Vehicle on the basis of a 4 weeks rental) and with a full fuel tank and one full gas bottle.
 
The Hirer will return the Vehicle in a clean condition with a full fuel tank, on the return date and time set out under the heading 'Check in' in the Rental Agreement, otherwise he will pay Budget Motorhome Rental cleaning fee of €220 (except if he subscribes to the “Cleaning option”),
 
The Hirer acknowledges that Budget Motorhome Rental will not refund to him any monies, nor has any obligation to provide a replacement vehicle, if the Vehicle is returned or the Hirer ceases to have the use of the Vehicle prior to the return date for any reason e.g. accident, weather or theft.
 
            - Security Deposit
 
On taking delivery of the Vehicle, the Hirer agrees to pay the Security Deposit,
 
The Hirer authorises Budget Motorhome Rental to deduct from the Security Deposit any amounts due by him to Budget Motorhome Rental arising out of this Agreement,
 
The security deposit will be refunded as soon as possible after the Vehicle being returned to the correct location, undamaged, with a clean interior with a full fuel tank. Budget Motorhome Rental reserves the right to retain the totality or a part of the security deposit if the vehicle is not returned with the interior in a clean condition.
 
            - Vehicle Damage – Insurance Cover
 
The Vehicle is insured for damage to the Vehicle and the property of a third party.
 
The Hirer will have to pay an excess for any damage (unless CDW – Collision Damage Waiver - is used). The insurance excess is €3000.
 
The excess may be reduced, in most circumstances, by taking out a CDW. With the purchase of CDW, the Hirer’s responsibility is reduced from €3000 to €500.
 
The Hirer will not have any insurance cover and will be responsible for the total cost of any damage if he breaches any of the terms of this Agreement.
 
            - Use of the Vehicle
 
The Hirer agrees that the use of the Vehicle is expressly limited and restricted to the driver and/or such authorized persons, as provided in this Agreement.
 
The Hirer must not:
 

 - sublet or rent the Vehicle to someone else,

 - allow or permit the Vehicle to be driven otherwise than in a cautious and prudent way,

 - allow or permit the Vehicle to be driven in a prohibited area,

 - allow or permit the Vehicle to be driven by a person under the influence of alcohol or drugs or with a blood alcohol level in excess of that permitted by law in the Country, State or Territory where the Vehicle is driven,

 - allow or permit the Vehicle to be driven by persons under the age of 21 years, or who are not authorized by maw to drive the Vehicle,

 - left with the ignition key in the Vehicle while it is unoccupied,

 - allow or permit the Vehicle to be used for any illegal purpose, race, and contest or rally of any kind,

 - allow or permit the Vehicle be used to tow or push anything,

 - damage the Vehicle by submersion in water,

 - damage the Vehicle by contact with Salt Water,

 - use the Vehicle to carry more persons than is permitted by any relevant authority or detailed in the Vehicle manual or on the Vehicle or specified in this Agreement,

 - use the Vehicle to carry volatile liquids, gases, explosives or other corrosive or inflammable material,

 - use the Vehicle in breach of his obligations under this Agreement

 - use the Vehicle in breach of any legislation , regulations, rules or laws in relation with road traffic

 

           - Responsability

 

The Hirer must :           

 - take all reasonable steps to properly maintain the Vehicle, including oil checks, water and batteries . The Hirer will be reimbursed for expenditure reasonably incurred in rectifying any mechanical failure to the drive train and engine of the Vehicle (not including the water system, refrigerator, heating, audio and DVD equipment ) Provided that:

 
-          the Hirer produces relevant receipts,

-          the Hirer has received the prior consent of Budget Motorhome Rental,

-          the damage is not due to the Hirer’s fault or his breach of this Agreement.
 

 - pay for the cost of repairing or replacing tyres damaged during the Rental Period PROVIDED THAT Budget Motorhome Rental will reimburse him for expenditure reasonably incurred if :

 
-          the Hirer produces relevant receipts

-          the tyre is defective and is returned by the Hirer to Budget Motorhome Rental for inspection,

-          the manufacturer accepts liability under his warranty

In case of any accident, loss or damage arising out of the use of the Vehicle, the Hirer must :
 

 - notify Budget Motorhome Rental within 24 hours of the happening of the event,

 - obtain the names and addresses of third parties and any witnesses and report the event to the nearest police station

 
If the reserved Vehicle is not available, Budget Motorhome Rental reserves the right to substitute a comparable or superior vehicle at no extra cost to the client. Should a lower rated vehicle be offered, the responsibility of the rental company is limited to the refund of the difference in gross rates. This shall not constitute a breach of contract.
 
            - License
 
A full resident country driver license, held for a least one year, is to be presented at the pick-up location. If the license is not an English one, an international driver license is required.

Andorra, Austria, Belgium, Bulgaria, Croatia, Czech Republic, Denmark, Estonia, Finland, Germany, Great-Britain, Greece, Hungary, Italy, Ireland, Luxemburg, Monaco, Netherlands, Norway, Poland, Portugal, Romania, Slovenia, Slovakia, Sweden, Switzerland.

 

 Cancellation charges

 

More than 31 days before: 15% of total hire charge

30 – 21 days before: 40% of total hire charge

20 – 8 days before: 60% of total hire charge

Less than 7 days before: total hire charge
